FOREIGN CAPITAL GAINS WITHHOLDING CLEARANCE CERTIFICATE

Properties selling for, or valued at, $750,000 or more are required to provide the purchaser with an ATO Capital Gains Withholding Clearance Certificate, prior to settlement. This demonstrates that no capital gains amount is withheld at settlement.

SMOKE ALARMS

The New South Wales Government has been requiring residential properties to install fire alarms since 2006 under the Environmental Planning & Assessment Amendment (Smoke Alarms) Regulation 2006. 


Under this regulation, all types of properties – apartments, units, flats and houses – must have smoke alarms installed that comply with the Australian Standard.

SWIMMING POOLS

If you are planning to sell a property that comes with a pool, you must ensure that the pool complies with all the safety requirements. 

A child restraint barrier and a Warning Sign must be installed in near the pool. 


The contract for sale of your property must also contain a warning statement. In the event that this statement is not attached, the buyer of the property may rescind, or cancel, the contract.

An application or a compliance certificate from your local Council should also be processed prior to listing your property for sale.

LAND TAX

Land tax is a state tax levied on land in NSW as of midnight on the 31st of December of each year.
Your property’s value is obtained from the Valuer General’s Valuations.

Your accountant/tax agent can advise you in relation to any land tax liability.

HOMEOWNERS WARRANTY INSURANCE

Under the Home Building Act 1989, a licensed Builder selling residential property within 6 years of completion of the residential building works, must have Home Owners Warranty Insurance at the time they exchange contracts for the sale of the property. 


In the event that the insurance is not available at the time of the exchange of contracts, the purchaser can rescind the contract any time before settlement and the vendor can be fined.
